Program Terms and Conditions

APPLICATION

Upon your decision to submit an application for a Sportek Travel program, a per person deposit (athletes and accompanying family members) is required. The program specific deposit is described in the program contract. The applicant will be required to submit a player resume and references pertaining to the athletic skill and personal character of the athlete. The applicant may have his/her references interviewed by a selection committee member. Applicants are accepted into the program pending the receipt of their resume and references. The application reserves your space in the program and on a team. Applicants not accepted into a program receive a full refund of the application deposit.

PROGRAM CONTRACT

Each Sportek Travel program has a specific program contract. The program contract contains the program costs and payment options. Most programs require final payment 70 days prior to the program start date. Program contracts describe the specific travel and sports competition associated with the program. Our program costs combine special rates we receive from hotel, air and land transportation suppliers. We cannot breakdown the price for the individual components. Our programs offer participants the convenience and savings of arranging their entire trip in one transaction.

CANCELLATION FEES

Should an applicant (athlete or accompanying family member) cancel their participation in a Sportek Travel program there are cancellation fees. After application to a program the cancellation fees increase over time. The minimum cancellation fee is $50. The program specific cancellation fee schedule is described in the program contract.

TRAVEL INSURANCE

Sportek Travel offers travel cancellation insurance via an independent insurance program at an additional cost. Included in this optional program are travel cancellation, travel interruption, secondary group health and emergency medical insurance. We strongly recommend that you choose to purchase the travel cancellation insurance. Program participants who choose to decline the travel cancellation insurance are responsible for all program cancellation fees.

SIGHTSEEING AND EXCURSIONS

Sightseeing and excursions via motorcoach are included as well as some possible entrance fees where applicable. This information is detailed in the program contract.

TRANSPORTATION

As agents for most airlines, Amtrak and motorcoach carriers, we will provide you with the most reliable and reasonable carrier. Economy-class air transportation is arranged based on excursion APEX fares via regularly scheduled airlines. Reservations, ticketing and full payment must be completed per the regulations of the airline. Air carriers and schedules listed in the itinerary are subject to change.

PROOF OF IDENTITY

Proof of identity is required for international travel. Without proper identification, a passport and necessary visas, you will not be permitted to depart. It is your responsibility to obtain and verify your necessary travel documents.

TARIFF AND EXCHANGE FLUCTUATIONS

Program prices are subject to change without notice due to the currency fluctuations, tariff changes or increase in operational costs. In addition, all program costs are per person and based on a minimum number of persons traveling, if the number falls below the minimum required, a surcharge may be imposed.

PROGRAM FARE DOES NOT INCLUDE

The cost of the program covers service charges normally mentioned in the itinerary and program contract. Passport, visa, laundry, meals not on the itinerary, tips to baggage porters and similar tipping charges, add-on air travel charges for baggage, items of personal nature, including souvenirs and sight-seeing not a part of program itinerary, are not included in the cost of the program. Hotel charges such as extra person fees, parking, phone calls, room service or energy surcharges and property damages are not included in the cost of the program and must be handled directly between you and the hotel.

DISCLAIMER

Sportek Travel and the independently owned and operated program operator, and/or its agents, acts only as reservation or booking agents in the matters relation to transportation, accommodations, services, festival and competition management and facilities provided by other independent parties. Therefore Sportek Travel shall not be responsible for the quality of goods, accommodations or services, breach of contract or any intentional or careless of actions or omissions on the part of any such provider or suppliers, which result in any loss, damage, delay, or injury to you, your travel companions or group members, or which in personal dissatisfaction with the quality of goods, accommodations or services. Sportek Travel shall not be responsible for any injuries, damages or losses to person, property or otherwise in connection with any accommodations, transportation, or other services provided or supplied by others or resulting directly or indirectly, from acts of God, fires, breakdowns in equipment outside Sportek Travel’s control. Sportek Travel will not be responsible for any loss or damage resulting from improper or insufficient passports, visas, or other documents. Sportek Travel will not be liable for any additional expense or liabilities sustained or incurred by program members as a result of any of the above stated conditions. The full responsibility for the vehicles and the operation of the vehicles in these programs rests solely with the particular carriers and the liability of such carriers is governed by the country of operation. Sportek Travel reserves the right to decline, to accept or to retain any person as a member of Sportek Travel’s programs at anytime. Sportek Travel further reserves the right to dismiss participants from a program and return them home, at participant’s expense, for demonstrated inappropriate behavior, which includes, but is not limited to, use or purchase of alcohol, use or purchase of controlled substances of any kind, violation of United States or host country law, vandalism or destruction to property or facilities, and/or lewd or indecent behavior. If any program must be withdrawn or canceled prior to the passenger’s departure on the program, the liability to Sportek Travel is limited to a refund of moneys received by Sportek Travel. Reasonable changes to your itinerary due to unforeseen circumstances may be made where deemed necessary for the well being of the program. Although every effort to accommodate your booking will be made on the dates requested, Sportek Travel does reserve the authority to modify the travel dates by up to two days (early or later) based on requirements by the tournament organizer or international air carriers. All travel departure dates will be finalized 60 days prior to departure. Sportek Travel, is registered as a “Seller of Travel” with the California Attorney General, registration #2090660-40. Registration as a seller of travel does not imply approval by the State of California.

VENUE

The validity, interpretation, enforcement and performance of this Sportek Travel. Contract and Terms and Conditions shall be governed and construed in accordance with the laws of the State of North Carolina. The venue for any action involving or arising under this Sportek Travel Contract and Terms and Conditions shall be in Wake County, North Carolina and the undersigned participant and parent/guardian and Sportek Travel each consent and subject themselves to jurisdiction in Wake County, North Carolina.

GENERAL RELEASE

Sportek Travel may record the traveling member (athlete or adult) who is an active participant on the program during competition, sightseeing or at general daily activities on video tape, audio tape or photograph, and may use the applicant’s name, voice or testimonial without restriction for the future promotional purpose of Sportek Travel unless stated otherwise in writing.
